Children and youth with disabilities have the right to access free public education services and supports that help them fully participate in school and reach their individual learning goals. Refugee and newcomer families may not be familiar with the U.S. special education system or may face challenges related to language access, navigating school processes, understanding evaluations, or advocating for their child’s needs. 

Under the Individuals with Disabilities Education Act (IDEA) and Section 504 of the Rehabilitation Act, eligible students may receive specialized instruction, accommodations, related services, and individualized supports through an Individualized Education Program (IEP) or 504 Plan. Schools are responsible for identifying, evaluating, and supporting students who may have disabilities that impact learning or school participation. 

The resources below are designed to help providers, educators, and caregivers better support refugee and newcomer children and youth with disabilities and advocate for access to special educational services and supports.
